These Terms of Service ("Terms") govern your access to and use of the Enzonic Cloud API platform ("API Platform") provided by Enzonic LLC, a Kentucky limited liability company ("Enzonic," "we," "us," or "our"), available at cloud.api.panel.enzonic.com. By registering for or using the API Platform, you agree to these Terms.

1. Eligibility

You must be at least 13 years old and have the legal capacity to enter into a binding agreement. By using the API Platform you represent that you meet these requirements.

2. Account Registration

You must provide accurate, complete information when registering. You are responsible for all activity under your account. Notify us immediately at admin@enzonic.com if you suspect unauthorized access.

3. API Keys and Scoped Access

You may create API keys to authenticate programmatic access to the API Platform. You are responsible for keeping your API keys confidential. Do not embed keys in public repositories or client-side code. Revoke compromised keys immediately via your dashboard.

4. Acceptable Use

You agree not to use the API Platform to:

Deploy or distribute malware, viruses, or other malicious code.
Conduct denial-of-service attacks against any system.
Mine cryptocurrency or run workloads unrelated to game or application server hosting.
Infringe any third-party intellectual property or other rights.
Violate any applicable law or regulation.
Resell API access without prior written permission from Enzonic.
Circumvent rate limits, billing controls, or security measures.

5. Payment and Credits

The API Platform uses a prepaid credit system. Credits are purchased in advance and consumed based on resource usage (RAM, CPU, storage). Prices are displayed on the pricing page and in your dashboard. Credits are non-refundable except as required by law.

6. Rate Limits and Fair Use

We enforce rate limits to ensure fair access for all users. Exceeding rate limits may result in temporary request throttling. Repeated or severe abuse may result in account suspension.

7. Service Availability

We aim to provide a reliable API Platform but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability and are not liable for losses arising from downtime.

8. Intellectual Property

All content, trademarks, and software comprising the API Platform are owned by Enzonic LLC or our licensors. You retain ownership of applications you build using the API.

9. Termination

We may suspend or terminate your access at any time for violation of these Terms, non-payment, or to protect the integrity of the platform. Upon termination your right to use the API Platform ceases immediately.

10. Disclaimer of Warranties

THE API PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENZONIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE API PLATFORM. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Enzonic LLC and its officers, employees, and agents from claims, damages, or expenses arising from your use of the API Platform, your violation of these Terms, or your infringement of third-party rights.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky. Disputes shall be resolved exclusively in the state or federal courts of Kentucky.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated by email or notice on the platform. Continued use after changes constitutes acceptance.
